ELAINE FRESCH HEADS UP A PANEL DISCUSSION ON CHAPTER 40 ISSUES AT WEST COAST CASUALTY'S CONSTRUCTION DEFECT SEMINAR
Elaine Fresch, partner in charge of the firm's Construction Defect Department, spoke at West Coast Casualty's 15th annual Construction Defect Seminar being held on May 7, 8 and 9, 2008 at the Disneyland Hotel. Ms. Fresch chaired a panel discussion entitled "Complicated and Convoluted: The Chaos of Chapter 40." Her co-panelists were Nevada Supreme Court Chief Justice Mark Gibbons, Nevada Supreme Court Justice Michael Cherry, Karen Rice, National Construction Defect Claim Manager of OneBeacon Insurance, Duane Shinnick, who represents homeowners and associations and David Lee, Esq., whose practice focuses on the representation of "target" defendant contractors.
The panel discussed the issues and challenges of Nevada's Right To Repair Statute, aka Chapter 40, and what they mean for insurers and those practicing in Nevada.
