NEIL SELMAN TO SPEAK AT LORMAN BAD FAITH SEMINAR IN LOS ANGELES
Neil Selman will be part of a distinguished program of bad faith experts when he presents a discussion on the "Genuine Issue Doctrine: A Summary Method of Defeating Bad Faith Claims" for the nationally recognized Lorman Education Services seminar on Bad Faith on May 19, 2005 in Los Angeles. The panel will also include Thomas Girardi, Jerry Ramsey, Harvey Levine and Alex Polsky. The all day seminar is given annually and this will be Mr. Selman's third presentation at the Bad Faith seminar. It is intended for lawyers and claims people involved in the extracontractual area.
The genuine issue doctrine allows insurers to move for summary adjudication of bad faith causes of action based upon the presence of legal issues or factual disputes that present an actual good faith dispute such that even if the carrier turns out to be wrong, the carrier would be liable for the covered loss but not extra-contractual claims. Mr. Selman's presentation discusses the evolution of the legal theory, the types of cases in which it can be used, and the arguments raised in opposition to such motions.
